Refund and Right of Withdrawal Policy
1. Right of Withdrawal
Consumers have the right to withdraw from a distance contract or a contract concluded away from the trader’s business premises within fourteen (14) calendar days, without giving any reason, subject to the exceptions provided for by applicable law.
2. Withdrawal Period
The withdrawal period expires fourteen (14) calendar days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Where several goods ordered in a single order are delivered separately, the withdrawal period expires fourteen (14) calendar days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the last item.
To meet the withdrawal deadline, it is sufficient for the consumer to send the withdrawal notice before the withdrawal period expires. The consumer must be able to demonstrate that the notice was sent within the applicable period.
3. How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, the consumer must inform the seller of their decision by making an unequivocal statement.
The notice may be sent by email to calikonoplja@gmail.com or by post to the seller’s address stated below.
The consumer may use any clear statement expressing their decision to withdraw from the contract. Using a standard withdrawal form is not mandatory.
4. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in the cases specified by applicable law, including:
-
Goods made to the consumer’s specifications or clearly personalised.
-
Goods liable to deteriorate or expire rapidly.
-
Sealed goods that are not suitable for return for reasons of health protection or hygiene, where the seal has been removed after delivery.
These exceptions apply only where the relevant legal conditions are met.
5. Refunds
If the consumer validly withdraws from the contract, the seller will reimburse all payments received from the consumer, including the cost of standard delivery, without undue delay and no later than fourteen (14) calendar days from the day on which the seller is informed of the consumer’s decision to withdraw.
If the consumer expressly chose a delivery method more expensive than the least expensive standard delivery option offered by the seller, the seller is not required to reimburse the additional delivery costs.
For sales contracts, the seller may withhold the refund until the returned goods have been received or the consumer has provided evidence of having sent the goods back, whichever occurs first, unless the seller has offered to collect the goods.
6. Refund Method
Refunds will be made using the same payment method that the consumer used for the original transaction, unless the consumer expressly agrees otherwise and provided that the consumer does not incur any fees as a result of the refund.
No additional fees will be charged to the consumer for processing the refund.
7. Return of Goods
The consumer must send the goods back to the seller without undue delay and no later than fourteen (14) calendar days from the day on which the consumer informed the seller of their decision to withdraw from the contract.
The deadline is met if the goods are dispatched before the fourteen-day period expires.
Goods must be returned by post or another suitable shipping method to the address specified below.
8. Return Address and Condition of Goods
Returned goods should be sent, together with any accessories supplied with them and, where possible, their original packaging, to the following address:
Cali obrt za usluge i trgovinu
Ulica Bjeliš 23
35000 Slavonski Brod
Croatia
The consumer may handle and inspect the goods to the extent necessary to establish their nature, characteristics and functioning, as they would be permitted to do in a physical shop. The consumer may be liable for any diminished value resulting from handling beyond what is necessary for such inspection, in accordance with applicable law.
9. Return Shipping Costs
The consumer bears the direct cost of returning the goods, provided that the consumer was informed of this obligation before placing the order and unless the seller has agreed to bear those costs.
This policy does not affect any mandatory consumer rights under applicable law, including rights relating to faulty, damaged or incorrectly supplied goods.
